Terms of Service

1. Agreement & Definitions
By accessing or using IQFinancial’s services (the “Service”), you (“Client”) agree to be bound by these Terms, our Privacy Policy (last updated August 18, 2025), and any additional terms communicated to you. If you don’t agree, don’t use this Service.
“AI Agents” means the suite of AI-powered automation tools delivered by IQFinancial to improve your sales follow-ups, customer engagement, lead conversion, or Google Reviews.
2. Services
IQFinancial provides AI Agents that:
- Follow up with leads via WhatsApp/SMS in a human-sounding way;
- Book appointments or demos;
- Nudge old leads back to life;
- Drive upsells, cross-sales, and improved reviews;
- Provide analytics and performance insights.
3. Client Responsibilities
You must:
- Provide accurate, lawful data (leads, customer info, messaging preferences).
- Ensure compliance with all applicable laws, including privacy, telemarketing, anti-spam, and messaging regulations.
- Obtain necessary consents from your customers to receive AI-crafted messages, especially via SMS or WhatsApp.
4. Privacy & Data
We handle your data under our Privacy Policy’s framework. That means we collect only what you authorize, protect it, and follow Canadian laws like PIPEDA and Quebec’s Law 25.
You’re responsible for what you upload. You own the content, and you must have the rights to give it to us.
5. Intellectual Property
IQFinancial owns all IP in the AI Agents, algorithms, interfaces, and platform. You get a limited, non-exclusive, revocable license to use the Service during the agreed term. Don’t decompile it, don’t claim it’s yours.
Any content you provide stays yours—but we may anonymize and aggregate it to improve our AI or to share case studies (unless you opt out in writing).
6. Term, Renewal & Termination
- Term = your subscription period, as per your agreement.
- Renewal is automatic unless cancelled with written notice at least 30 days before end-of-term.
- We can suspend or terminate if you breach these Terms. You can cancel any time, but you remain liable for fees due during the cancellation notice period.
7. Fees
You pay as agreed: setup fees, monthly/annual usage fees, and any overage charges. No refund of already-processed periods. We may adjust fees with at least 30 days’ notice.
8. Warranties & Liability
Service is provided “as is.” We don’t guarantee specific results—though we confidently promise we’ll work hard for them.
To the extent allowed by law:
- No implied warranties (merchantability, fitness, performance).
- Liability capped at the total fees you paid in the past 12 months.
- No liability for lost profits, indirect damages, or downstream chaos.
9. Indemnification
You defend, indemnify, and hold IQFinancial harmless from claims arising from your use of the Service—violations, misrepresentations, or legal troubles caused by messaging or data misuse.
10. Governing Law & Dispute Resolution
Terms governed by the laws of Quebec, Canada. Disputes resolved through arbitration in Montreal (or another agreed city), in English or French as you prefer. Other than that, courts are free to settle location if needed.
11. Modifications
We can change these Terms, giving you notice 30 days in advance for material updates. Continued use after that means you’re good with the changes.
12. Entire Agreement
These are the full terms. They replace any prior understandings. If any part is invalid, the rest stands. No waiver if we don’t enforce something once—it doesn’t excuse next time.a
